Terms

Effective May 3, 2026

These Terms of Service (“Terms”) govern your use of EstatePacket (“EstatePacket,” “we,” “us”). By accessing this site or using the application, you agree to these Terms on behalf of yourself and the firm you represent.

Software, not legal advice

EstatePacket is software, not legal advice and not the practice of law. The Draft Estate Packet is intended for attorney review and verification before any filing or client action. We do not access financial institutions on behalf of executors and we do not produce filed court documents. Use of the service does not create an attorney-client relationship between you and EstatePacket.

Scope of service

The current build searches one live source (MissingMoney.com, scoped to California) and three cached snapshots (FINRA BrokerCheck, SEC EDGAR, Los Angeles County Recorder). The Los Angeles County Recorder snapshot is a synthesized illustration of how recorded-instrument data would surface; it does not represent real recorded instruments. Coverage outside California is not supported in this prototype.

Account and acceptable use

You agree to (a) provide accurate decedent identifiers, (b) submit only matters you are authorized to handle, (c) review every Draft Estate Packet before any reliance or filing, and (d) refrain from probing, reverse-engineering, or overloading the service. You are responsible for maintaining the confidentiality of any access credentials we issue to your firm.

Pricing and payment

$295 per estate. No subscription. Volume pricing above 50 estates per year. Invoiced to the firm. Net 30. Invoices unpaid after 30 days may be assessed a late fee of 1.5% per month or the maximum allowed by law, whichever is lower.

Confidentiality and data ownership

The decedent identifiers and matter information your firm submits remain owned by your firm. We use them only as described in our Privacy policy and as required to deliver the Draft Estate Packet. We will not disclose matter information to third parties except subprocessors disclosed in the Privacy policy or as compelled by law.

Intellectual property

This site, the application, the design system, and the underlying software are the property of EstatePacket and protected by intellectual-property law. Output documents (the Draft Estate Packet) generated for your matter are licensed to your firm for use on that matter and successor matters within the firm.

Disclaimers

The service is provided “as is” and “as available.” To the maximum extent permitted by law, EstatePacket disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Public-records sources are operated by third parties and may be unavailable, incomplete, or out of date; the Draft Estate Packet reflects what those sources returned at the time of the query and is not a guarantee that all assets have been identified.

Limitation of liability

To the maximum extent permitted by law, EstatePacket’s aggregate liability for any claim arising out of or relating to the service is limited to the fees actually paid by your firm to EstatePacket for the matter giving rise to the claim in the twelve months preceding the claim. EstatePacket is not liable for indirect, incidental, consequential, exemplary, or special damages, including lost profits.

Indemnification

You agree to indemnify and hold EstatePacket harmless from any third-party claim arising out of (a) matter information you submit that you were not authorized to submit, or (b) your use of the Draft Estate Packet without the attorney review the document on its face requires.

Termination

Either party may terminate the engagement at any time for convenience. Outstanding invoices remain due through termination. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive.

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. The exclusive venue for any dispute is the state and federal courts located in California.

Changes

When these Terms change materially we will update the effective date above and notify firms with active matters by email. Continued use after the effective date constitutes acceptance.
